This Glossary is part of the Hotmart Terms of Use. It lists the meanings of the expressions that start with capital letters in the Hotmart Terms or in other Policies. We suggest that you read the following definitions carefully and attentively.

Affiliate: User registered in the Affiliate Program who, while using Hotmart Services, sells Products in exchange for a remuneration equivalent to a percentage of the amount of each sale they promote.

Affiliate Program: A Hotmart Service where Creators allow Affiliates to sell Products for a remuneration equivalent to a percentage of the amount of each sale that they make.

Buyer: User who purchases any Product registered on the Platform.

Collaborator: User registered by a Creator to manage the Creator's account, without the need to share the Creator's access credentials.

Content (or Product): Content in various digital formats (video, audio, text, software, etc.) created by a Creator or licensed to a Creator by third parties, and made available on the Platform, such as, but not limited to, courses, e-books, podcasts, communities, among others.

Contract: The binding contract signed between you, as the User, and Hotmart, which governs your access and use of the Platform and its Services.

Creator: User who registers a Product on their behalf and is the exclusive holder of all intellectual property rights relating to the Product, or who is regularly authorized by the holders of these rights to create, disclose, and market the Product on the Platform.

Display: Area through which Creators make their Products available to be disclosed on the Hotmart website.

Hotmart BR: Launch Pad Tecnologia, Serviços e Pagamentos Ltda., a private legal company, registered with the CNPJ/ME under no. 13.427.325/0001-05, headquartered in the city of Belo Horizonte, State of Minas Gerais, at Avenida Assis Chateaubriand, no. 499, Bairro Floresta, CEP 30.150-101.

Hotmart B.V.: Dutch company, headquartered at Spuistraat 168 C, 1012 VT, Amsterdam, the Netherlands, KVK CCI registration nº 60335777.

Hotmart Platform or Platform: The website www.hotmart.com and its subdomains, as well as any other websites, interfaces, or applications in which Hotmart makes its resources available.

Hotmart Policies: Collectively, Hotmart's Payment Policy for Brazil, Hotmart's Payment Policy for International Transactions, Hotmart's Responsible Use Policy for Brazil, Privacy Policy, and Cookies Policy.

Hotmart Services or Services: Collectively, the resources made available by Hotmart that allow Users to consume, create, promote, or sell Products on the Platform.

HotPay: Hotmart's payment system that processes the payment instructions made by Buyers and settles them for Creators and Affiliates, according to the rules and procedures determined in the Payment Policy and Hotmart Terms.

HotPay Services: Collectively, the HotPay resources that process the payment instructions made by Buyers and settle them for Creators, Co-producers, and Affiliates.

Intermediation Fee: A fee Hotmart charges Creators for the use of the Hotpay features, in a varying amount, based on the Product's sales price. 

License Fee: A Fee Hotmart charges Creators for the use of the HotPay features, in a fixed amount, applicable according to the currency used by Buyers to make the purchase.

Marketplace: The platform's shopping area, available as a virtual showcase to present Products to Users.

Product (or Content): Content in various digital formats (video, audio, text, software, etc.) created by a Creator or licensed to a Creator by third parties, and made available on the Platform, such as, but not limited to, courses, e-books, podcasts, communities, among others.

Registration Information: Consists of information, such as parents’ names, address (including email address), full name, first name, marital status, and profession of the User.

Related Third Parties: Any persons, natural or legal, who are directly or indirectly related to a Product, such as experts, actors, characters or endorsers.

Service Fee: Fee that Hotmart charges Creators to use HotPay's resources, the fee varies according to the Product’s sale price.

Terms: Hotmart’s Terms of Use.

Third-Party Services: Third-party websites, applications, or resources made available to Users through the Platform.

Trial Feature: Feature that allows a period of free use by the Buyer, which can vary from one to 30 days, as decided by the Creator, and that has the purpose of allowing new Buyers to try the Product.

User: Any person who accesses or uses the Platform, regardless of whether they have registered as a Creator, Affiliate, or Buyer.

User-generated Content: content that is created and made available by Users in text, audio, image, video, document, among other formats, for purposes of evaluating Products and/or inserting comment(s) in the Services and/or on the Platform.
